Terms of Service
Last updated: 07.07.2025
1. Introduction
Welcome to mlpotentials.com ("we", "us", "our"). By accessing or using our SaaS platform that grants access to interatomic machine-learned potential APIs ("Service"), you agree to comply with these Terms of Service ("Terms"). If you do not agree, please do not use our Service.
2. Eligibility and Account
To use our Service, you must create a user account. Access to the API is granted via API tokens linked to your account, which you must keep confidential. You are responsible for all activity under your account.
3. Service Description
Our Service provides access to machine-learned interatomic potential models via API. Models may be licensed under different licenses (Creative Commons, MIT, proprietary). License details are available on each model's page. Compliance with these licenses is your responsibility.
4. Usage and Restrictions
The Service includes a free tier with limited access to the API, available only during idle times. Misuse of the free tier, including redundant or excessive requests that resemble denial-of-service (DoS) behavior, is prohibited. Paid usage has no restrictions, but must comply with these Terms.
5. Payment and Tokens
The Service operates on a prepaid token system. Tokens are consumed based on usage. Payments are processed by Paddle, the Merchant of Record. By purchasing tokens, you agree to Paddle's terms and conditions. Purchased tokens generally are non-refundable except as detailed in our Refund Policy.
6. Data Collection and Privacy
We collect your username, email, billing information, and anonymized API usage data to provide and bill the Service. Detailed personal data and input/output data are not logged. For full details, see our Privacy Policy.
7. Termination
We may suspend or terminate your account for violation of these Terms or misuse of the Service. You may terminate your account at any time by contacting us.
8. Limitation of Liability
Our Service is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages. Liability is limited to the amount you paid for tokens in the prior 12 months.
9. Governing Law and Dispute Resolution
These Terms are governed by German law. Exclusive jurisdiction lies with the courts in Wuppertal, Germany. Before any court action, both parties agree to attempt to resolve disputes through arbitration.
10. Changes to Terms
We may update these Terms at any time. Changes will be posted on the website with a new effective date.
